These Terms of Use (“Terms”) govern your access to and use of fuelsolarlift.com (the “Site”), operated by FUEL Innovation Design & Manufacturing Inc. (“FUEL,” “we,” “us”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
The Site is informational
The Site presents information about the FUEL Solar Lift and related products and lets you contact us, request a quote, or place an order inquiry. It does not by itself form a contract of sale. Any order is subject to our acceptance and to the sale terms we confirm with you (including price, availability, shipping, taxes, and payment).
Product information & specifications
We work to keep product descriptions, specifications, compatibility lists, and prices accurate and current, but we do not warrant that they are complete or error-free, and they may change without notice. Prices are in Canadian dollars unless stated otherwise; U.S. orders are billed at the equivalent amount, and shipping and applicable taxes are extra. Specifications are provided for general guidance and are not a substitute for professional judgment or the product documentation.
Safety & assumption of risk
The FUEL Solar Lift and related equipment are used to raise and lower loads at height. You are responsible for using them safely and lawfully, including: following the user manual, safety guides, and any load and ladder-compatibility limits; using appropriately trained personnel and required protective equipment; inspecting equipment before use; and complying with all applicable workplace, occupational-health-and-safety, and building regulations. You assume the risks of working at height and of use that does not follow our documentation. Nothing on the Site is engineering, safety, or legal advice for your specific situation.
Warranty & returns
Our product warranty and return terms are described on the Site (see the pricing, support, and product pages) and in the materials provided with your order. Those terms govern warranty and returns; this page does not expand or replace them. Except as expressly stated there or required by law, products and the Site are provided “as is.”
Intellectual property
The Site and its content — text, images, video, logos, and the FUEL and FUEL Solar Lift marks — are owned by FUEL or its licensors and are protected by intellectual-property laws. You may view and print pages for your own reference, but you may not copy, reproduce, distribute, or create derivative works from the Site’s content for commercial purposes without our written permission.
Acceptable use
You agree not to misuse the Site — including attempting to disrupt or gain unauthorized access to it, submitting false or unlawful information through our forms, using it to send spam or malware, or scraping or harvesting data in a way that burdens the Site or violates these Terms.
Third-party links
The Site may link to third-party sites and content (for example, product videos on YouTube). We do not control and are not responsible for third-party sites or their content and policies; your use of them is at your own risk and subject to their terms.
Disclaimers & limitation of liability
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, FUEL will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of — or inability to use — the Site or its content. Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.
Governing law
These Terms are governed by the laws of the Province of Alberta and the laws of Canada applicable there, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located in Alberta, Canada.
